1. Introduction

These Terms of Service ("Terms") govern your access to and use of Stonn, a construction site documentation platform including our mobile application and web services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Stonn provides a software platform for construction site documentation, offering:

  • 360° panorama capture and management using compatible cameras (including Insta360 devices)
  • Project organization with floor plans and location mapping
  • Cloud storage and synchronization of construction documentation
  • Mobile and web applications for accessing and managing your projects
  • Team collaboration features for sharing projects within organizations

3. Account Registration

To use our Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Be at least 18 years old or have legal capacity to enter into these Terms
  • Keep your password confidential and secure
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates applicable laws or regulations
  • Upload content that infringes on intellectual property rights of others
  • Attempt to gain unauthorized access to any portion of the Service or its systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Transmit any viruses, malware, or other harmful code
  • Use the Service to store or transmit illegal content
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems or software to extract data from the Service
  • Impersonate any person or entity, or misrepresent your affiliation

5. User Content

Ownership: You retain all ownership rights to the content you upload, including panorama images, floor plans, project data, and other materials ("User Content"). We do not claim ownership of your User Content.

License: By uploading User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, display, and transmit your User Content solely for the purpose of providing the Service to you. This license terminates when you delete your User Content or close your account.

Your Responsibilities: You are solely responsible for your User Content and represent that you have all necessary rights to upload and share it. You agree not to upload content that is illegal, harmful, or infringes on the rights of others.

6. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding User Content), is owned by Grégoire DESHUSSES and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

7. Subscription and Payment

Some features of the Service may require a paid subscription. If you subscribe to a paid plan:

  • You agree to pay all applicable fees as described at the time of purchase
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Prices may change with notice; continued use constitutes acceptance of new prices
  • Refunds are handled in accordance with applicable consumer protection laws

8. Service Availability

We strive to provide reliable access to the Service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

9. Data and Backups

While we implement measures to protect your data, you are responsible for maintaining your own backups of important User Content. We recommend regularly exporting or backing up critical project data. We are not liable for any loss of data due to technical failures, user error, or other circumstances.

10. Termination

By You: You may close your account at any time through the account settings or by contacting us. Upon termination, your right to use the Service will immediately cease.

By Us: We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

Effect of Termination: Upon termination, you may request a copy of your User Content within 30 days. After this period, we may delete your data in accordance with our data retention policies.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GRÉGOIRE DESHUSSES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

Our total liability for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Grégoire DESHUSSES from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will notify you via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France. However, this does not affect your rights as a consumer under applicable consumer protection laws to bring proceedings in your country of residence.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
